1) Medi-cal Eligibility Benefits

Medi-cal and Medi-care – this need arises at the time that a loved one can no longer care for themselves – usually their last days (which could stretch out to be their last years) Here’s the objectives:

a. To obtain qualification for Medi-cal benefits for the patient, so that the family doesn’t have to private pay – usually $5,000-$6,000.00 per month.

b. To minimize the “share of cost� that must be paid from the patient’s income to the skilled nursing home.

c. To maximize the income of the well spouse in situations where a married person (ill spouse) must enter a skilled nursing facility and qualify for Medi-cal benefits.

d. To protect the assets of the patient, principally the home, from a Medi-cal claim by the State of California after the death of the surviving spouse – This is probably the most important service that the Elder Law attorney provides.

2) Asset Preservation, Protection And Repositioning.

Asset preservation, protection and repositioning. This principally comes into play in three areas:

a. Protection of assets from lawsuits, judgments, claims and levies – often in a business context.

b. Protection, principally of the family residence, from claims by the State of California resulting from public benefits paid out for the care of a loved one, in a skilled nursing facility (Medi-cal claims against the home), and

c. Bankruptcy

Conservatorship and Guardianship – Two areas

a. Dependant children – usually a situation wherein a grandparent, uncle, aunt, or older sibling has to step in and take charge of caring for and raising a minor child, often the offspring of an irresponsible, incapacitated, incarcerated or deceased parent

b. Elderly or dependant adults
1. Unable to provide properly for his or her personal needs for physical health, food, clothing or shelter
2. Substantially unable to manage his or her own financial resources or resist fraud or undue influence
3. Issues of capacity and incapacity

5) Probate Law

Probate Law – When a person who owns property, real or personal, dies, title to his or her property can’t pass to the heirs absent a court procedure known as probate, with some exceptions known as non-probate transfers or beneficiary designations. Some examples of non-probate transfers are:

a. Trusts
b. Retirement fund beneficiary designations
c. Life Insurance Policy Beneficiary designations
d. Bank account beneficiary designations
e. Real property held in Joint Tenancy

Sometimes, the heirs, or simply “interested� persons, contest a will, or object to the terms of the distribution, for example. The Elder Law attorney can either prosecute the contested matter or defend it, whatever is called for. Often, parcels of real estate are sold, as part and parcel of a probate proceeding. Virtually every Probate proceeding requires a detailed accounting of all assets transferred through the probate process, as well as an accounting of income, expenses, gains and losses on sales and distribution – These are all services that the Elder Law attorney provides.

Wills and Trusts – Occasionally, a client wants a simple will, and no trust, or a non-probate transfer document, other than a will or a trust. Also included under this service heading, for example, are

a. Trust Litigation – for situations where a beneficiary or other interested party challenges the creation of the trust, on the grounds of undue influence, for example, or demands an accounting, just as in a probate, or challenges the competency or the trustworthiness of the trustee of the trust. These are all situations where the Elder Law attorney can fulfill the needs of the person challenged or the person doing the challenging.

b. Special Needs Trusts are required for persons receiving public benefits that are needs based (as opposed to entitlement based), who come into money, either through inheritance, or by way of settlement of a personal injury claim, for example

c. Revocable Trusts enable a beneficiary to avoid the cost and time expended involving a probate

d. Irrevocable Trusts enable a Medi-cal benefit recipient to transfer their home to beneficiary(s) in order to protect the home from a Medi-cal claim, while preserving the available Capital Gains tax relief benefits for the beneficiaries.
