Phillip Jaffe meeting your Bankruptcy Attorney needs since 1991.
Phillip Jaffe is a New Yorker. He went to public school, high school and college in New York City. You may understand from the description that he understands and is aware of the problems that people have, many times not due to anything that those people may have done wrong, but due to outside influences that were many times beyond their control. Because of that there is virtually no problem that has beset a person or household that he does not understand.
Phillip Jaffe's practice has not only included bankruptcy, immigration, foreclosure prevention, student loans, Offers and Compromises with IRS to pay less tax, and personal injury but has also been involved in several class actions. Many of the actions that he has brought he has performed pro bono. Currently his office has a class action in the United States Federal Southern District Court (located in downtown Manhattan) against many major debt collection agencies for their violation of consumer rights and that many of the debt collection agencies violated court procedures when those agencies unlawfully sued consumers.
Likewise, also in the Southern District Federal Court, his office also has a suit against several banks for failure to provide loan modifications. The United States Government has provided more than 25 Billion Dollars for loan modifications but many of the largest banks in the United States have rather than aiding the homeowners whose homes are underwater - those banks have just pocketed the money as if the 25 Billion Dollars was a gift to them from Uncle Sam.
Similarly, in that same class action his office has sued for discrimination in that many purchasers of homes were unlawfully either charged higher interest rates because of where they lived or forced to take instead of one complete mortgage forced as a condition of the loan to take two separate mortgages. The second mortgage many times had an adjustable rate and at the banks' option required after a few years the person taking the mortgage to not only pay the interest of the second mortgage to in addition pay off a good part of the principal. It is, therefore, small wonder, why there are so many foreclosures - many of which may not be lawful.
As an example, if someone had been given a 7% interest rate rather than a rate that was not discriminatory of 6%, for a home loan, over a 30 year person that person would be paying approximately $263 more a month more than a person who was not discriminated against. Over the lifetime of the mortgage that amounts to almost $95,000.00 more. That difference would be enough to help several children have the benefit of a college education or pay for medical and hospital bills so that even a bankruptcy may not have been necessary.
