1) Contingency Fee Cases
One of my primary areas of practice are cases that are handled on a contingency fee basis. The type of contingency fee cases which I take are personal and workers’ compensation cases. “Contingent” means a certain agreed-to percentage or amount that is payable only upon attaining a recovery, regardless of the time or effort involved. This is different than a “time based” fee arrangement, which means a fee that is determined by the amount of time involved such as so much per hour, day or week. Another type of fee agreement is a “fixed” fee arrangement. “Fixed” means a fee that is based on an agreed amount regardless of the time or effort involved. I handle personal injury cases on a 33% contingency fee basis; workers’ compensation cases are handled on a %20 contingency fee basis.
2) Personal Injury
In the personal injury area, I primarily represent clients who are involved in serious automobile accidents which have caused physical, mental and/or economic damages, such as loss of a job due to injuries. I represent clients who are not at fault in causing the accident; generally the other driver, who would be the defendant in a civil action, has received a traffic citation and has failed to exercise reasonable care while operating his or her vehicle. If the automobile accident happens when my client is at work and operating a company vehicle, then that client may have both a workers’ compensation and personal injury case.
3) Workers' Compensation
4) D.u.i.
I also represent the individuals who have been charged with driving while intoxicated and/or driving while their ability is impaired. My representation includes pretrial, and or trial and sentencing. I generally will handle these cases on a fixed fee basis. I generally charge $750.00-$1000.00 through pretrial and $1500.00 to $2000.00 for a trial and require this fee prior to entering my appearance in the case.
5) Mediator
I am recently expanding my practice to include work as a mediator in the areas of personal injury and family law. The mediation process provides an opportunity for a neutral facilitator to meet with people in conflict and help them develop a mutually acceptable settlement. Parties can resolve disputes through mediation as an alternative to resolving disputes by litigating them in the court system and letting a judge decide the disputed issues. My practice has always included representing my client as an advocate in the mediation process where a judge or neutral third party acts as a mediator. Thus, I have settled personal injury, workers’ compensation cases and employment by law cases by using the mediation process. I charge $175.00 an hour for a mediation in a family law matter, and require a retainer in the amount of $3000.00 to $5000.00. I charge the same hourly rate for mediation in a personal injury case; the retainer fee would be $700.00 for a half day mediation and $1400.00 for a whole day mediation.
