1) Social Security Disability
Under the Social Security Act, qualified claimants can obtain benefits under 2 programs, Social Security Disability Insurance (“SSDI”) and Supplemental Security Income (“SSI”). Our firm has successfully handled thousands of Social Security disability claims since 1984 in virtually every category of disease or disability.
Given the current national economic crisis and the bureaucratic delays built into the system, it is imperative that claimants have experienced representation. This is true whether the claim is at the level of an initial application or before the Disability Determination Services agency, the Office of Disability Adjudication and Review, the SS Appeals Council, or the United States District Court.

A person who becomes disabled while working may be entitled to additional income benefits from work. Private employers often offer employee benefits to their employees, such as health insurance, life insurance, and disability income benefits. These benefits are governed by a federal law called the Employment Retirement Income Security Act, 29 U.S.C. § 1001 et seq., (“ERISA”). ERISA claim procedures are set out in 29 C.F.R. §2560.503-1.
ERISA benefit claims are very different from other types of litigation, and it is a dangerous landscape for unrepresented claimants. ERISA preempts all state laws, with few notable exceptions. ERISA has its own administrative appeal system. Only after exhausting all administrative appeals may a claimant file a lawsuit, but that lawsuit must be filed in the U.S. District Courts. ERISA has its own rules of civil procedure, evidence and rules limiting discovery. Damages are limited. In our opinion, only a handful of attorneys in Colorado have enough expertise to properly handle ERISA disability claims from start to finish.
Our heavy experience in this narrow area of law has taught us that the insurance companies reviewing claims of ordinary people unfairly take advantage of ERISA’s pitfalls and traps in order to deny as many claims as possible. Please, do not represent yourself in an ERISA case.
